Please read these terms carefully before using Sunu. By using our service, you agree to be bound by these terms.

Sunu is NOT a medical device and does NOT provide medical diagnosis, treatment, or advice.
- For informational purposes only: All AI insights are educational and should never replace professional medical consultation
- Not FDA approved: Our features are experimental wellness tools, not clinical diagnostics
- Always consult healthcare professionals: For any health concerns, symptoms, or medical decisions
- Emergency situations: Call 911 or your local emergency number immediately for urgent medical needs
By using Sunu, you acknowledge these limitations and agree to use the app responsibly alongside professional medical care.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Sunu Health, Inc. ("Sunu," "we," "our," or "us") governing your use of the Sunu mobile application and related services (collectively, the "Service").
By downloading, installing, or using Sunu, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the updated Terms.
You must be at least 18 years old to use Sunu. By using the Service, you represent and warrant that you meet this age requirement.
2. Description of Service
Sunu is a personal health companion app that helps you track and understand your health data. Our Service includes:
- Health Data Tracking: Integration with Apple Health to view and analyze your health metrics including heart rate, sleep, activity, and more
- Check-In & Mood Tracking: Tools to log your mood, arousal levels, and symptoms over time
- AI Health Assistant: An AI-powered chat interface for discussing your health data and receiving educational insights (includes 1-week trial for all users)
- Meal Logging: Tools to log and track your meals via camera, barcode scanning, or manual entry
- Experimental Features: Optional wellness tools including blink rate analysis and voice biomarker testing (Plus subscription required)
The Service is designed for informational and educational purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
3. Medical Disclaimer
The information provided by Sunu is not medical advice. Always seek the guidance of your doctor or other qualified health professional with any questions you may have regarding your health or a medical condition.
You expressly acknowledge and agree that:
- Sunu is not a substitute for professional medical advice, diagnosis, or treatment
- Never disregard professional medical advice or delay seeking it because of something you read or learned from Sunu
- AI-generated insights may contain errors and should be verified with healthcare professionals
- Experimental features (blink test, voice analysis) are for wellness exploration only, not clinical assessment
- In case of a medical emergency, call 911 or your local emergency services immediately
4. User Accounts
4.1 Account Creation
Sunu does not require an account to use. You may optionally create an account with your email address to enable cloud sync and access your data across devices. If you choose to create an account:
- You will need to verify your email address
- You are responsible for maintaining the confidentiality of your password
- Your account is personal and may not be shared with others
4.2 Guest Mode
You can use Sunu without creating an account. Guest data is stored locally on your device. Creating an account enables cloud backup and sync across devices.
4.3 Account Deletion
You may delete your account at any time through the Account section in Settings. Deletion permanently removes your account and all associated data from our servers. This action cannot be undone. For details on data retention, see our Privacy Policy.
5. Subscription and Billing
5.1 Free Features
Sunu offers free features that remain free forever, including:
- Health data tracking and Apple Health integration
- Check-in and mood tracking
- Meal logging
- Smart notifications
- 1-week AI Health Assistant trial (for new users)
5.2 Sunu Plus Subscription
After the 1-week trial, access to the AI Health Assistant and advanced features requires a Sunu Plus subscription:
- Unlimited AI Conversations: Continue chatting with your AI health assistant without limits
- Biomarker Testing: Access to blink test and voice analysis features
- Billing: Subscriptions are billed through the Apple App Store (monthly or annual plans available)
- Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Price Changes: We may change subscription prices; you will be notified in advance
5.3 Cancellation and Refunds
You may cancel your subscription at any time through your Apple ID account settings. Refunds are handled by Apple according to their policies. We do not process refunds directly.
6. User Conduct
You agree to use Sunu only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates any applicable laws or regulations
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers connected to the Service
- Use the Service to transmit harmful code or malware
- Impersonate any person or entity
- Use the Service for any commercial purpose without our express written consent
- Reverse engineer, decompile, or disassemble any part of the Service
7. Intellectual Property
The Service, including all content, features, and functionality, is owned by Sunu Health, Inc. and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. This license does not include the right to:
- Modify or copy the materials
- Use the materials for any commercial purpose
- Remove any copyright or proprietary notations
- Transfer the materials to another person or "mirror" the materials on any other server
8. Privacy
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key Privacy Commitments:
- Your personal data is never used to train AI models
- Health data is encrypted in transit and at rest
- We never sell your data to third parties
- Face data from blink tests is processed on-device only and never transmitted
- Voice recordings are deleted immediately after analysis
9. Third-Party Services
Sunu integrates with third-party services to provide our features:
- Apple Health: For accessing your health and fitness data with your permission
- Apple App Store: For subscription management and billing
- AI Service Providers: For powering our AI health assistant
- Cloud Services: For secure data storage and processing
Your use of these third-party services is subject to their respective terms of service and privacy policies.
10. Disclaimers
Important Legal Notice
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- Any errors in the Service will be corrected
- The Service will meet your specific requirements
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SUNU HEALTH, INC., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Any health decisions made based on information provided by the Service
Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless Sunu Health, Inc. and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
13. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.
Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account and associated data
- Any outstanding subscription payments remain due
- Provisions that by their nature should survive termination will survive
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Ramsey County, Minnesota, and you consent to the personal jurisdiction of such courts.
15. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:
- Posting the updated Terms in the app
- Updating the "Last updated" date at the bottom of this page
- Sending a notification through the app for significant changes
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
